Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ThisPrank ("we," "us," or "our"), governing your access to and use of the ThisPrank web application and all related services (collectively, the "Service").

By creating an account, uploading content, making a purchase, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

ThisPrank is a web-based AI photo manipulation platform that generates hyper-realistic, physically accurate photo edits for creative and entertainment purposes. The Service uses advanced AI image synthesis technology to produce composite images from user-submitted photographs and text prompts.

The Service is designed exclusively for:

• Harmless visual gags, jokes, and creative pranks
• Property "what-if" scenarios (e.g., visualizing changes to vehicles, interiors)
• Aspirational status photo edits (compositing users into new environments)
• Absurdist humor involving fictional creatures or scenarios

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

You must be at least 18 years of age to use the Service. By using ThisPrank, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used fraudulently or abusively.

You agree to use the Service only for lawful, non-harmful, and entertainment purposes. You are solely responsible for the content you upload and the outputs you generate.

When using the Service, you must:

• Only upload photographs that you own, have explicit permission to use, or for which you hold the necessary intellectual property rights
• Only upload images of individuals for whom you have obtained prior written or verifiable consent to edit and manipulate their likeness
• Use generated outputs responsibly and not in a manner intended to deceive, harass, defame, or harm any individual or group
• Comply with all applicable local, national, and international laws and regulations

The following are strictly prohibited on the Service:

• Non-consensual imagery: Uploading or generating manipulated images of real persons without their explicit, informed consent
• Deepfakes for deception: Using outputs to impersonate, defame, or deceive others, including spreading disinformation
• Sexual content: Generating or uploading any sexually explicit or suggestive material
• Minors: Uploading images of individuals under 18 years of age or generating any content involving minors
• Hate content: Creating content that promotes discrimination, hatred, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Harassment: Generating content designed to bully, harass, threaten, or intimidate any individual
• Political manipulation: Creating fabricated political content intended to mislead voters or interfere with electoral processes
• Illegal activity: Using the Service for any purpose that violates applicable law
• System abuse: Attempting to circumvent the Service's safety filters, reverse-engineer its AI systems, or overload its infrastructure
• Malicious impersonation: Generating content designed to fraudulently impersonate a real person for financial gain or reputational damage

Your Content: You retain all ownership rights to the original photographs and prompts you upload to the Service ("Input Content"). By uploading Input Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to process, store, and use such content solely for the purpose of providing the Service to you.

Generated Outputs: Subject to your compliance with these Terms and payment of applicable fees, you own the AI-generated image outputs ("Output Content") produced from your Input Content. We do not claim ownership over your Output Content.

Platform License: We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms.

Feedback: Any feedback, suggestions, or ideas you submit to us may be used by us without restriction or compensation to you.

You acknowledge and agree to the following regarding AI-generated outputs:

• Output Content is generated by artificial intelligence and may be imperfect, unpredictable, or inconsistent
• We do not guarantee specific results, quality, or accuracy of any generated image
• You are solely responsible for how you use, share, or publish Output Content
• Outputs may be used for personal entertainment only. You must not represent AI-generated outputs as authentic, unedited photographs when sharing them with third parties in a deceptive manner
• You agree to apply appropriate disclosures when sharing outputs on social media or other platforms, in accordance with platform-specific policies and applicable law

Certain features of the Service require payment. Payments are processed securely by Dodo Payments, our authorized merchant of record. By making a purchase, you also agree to their terms of service.

• Pricing: All prices are displayed in USD (or your local currency where applicable) and are inclusive of applicable taxes where required by law.
• Credit Packs: Credit packs are billed as a one-time upfront payment. There are no recurring charges or hidden subscription fees.
• Refunds: Due to the digital and immediately consumable nature of AI-generated content, all purchases are generally non-refundable. Exceptions may be granted at our sole discretion in cases of documented technical failure.
• Credits: Any purchased credits or tokens are non-transferable, non-refundable, and expire as specified at the time of purchase.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Any generated output will meet your expectations or requirements
• The Service will be free of viruses or other harmful components

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THISPRANK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) USD $50.

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including for violation of these Terms.

Upon termination:

• Your license to use the Service immediately ceases
• We may delete your account data in accordance with our Privacy Policy
• Any unused credits or prepaid fees are non-refundable unless required by law

You may terminate your account at any time by contacting us or using the account deletion feature within the Service.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email or a prominent in-app notice at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

These Terms shall be governed by and construed in accordance with applicable law. In the event of any dispute arising out of or relating to these Terms or the Service, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent immediate, irreparable harm.
